Intellectual Property Policy (DMCA)

Kaiserawa respects the intellectual property rights of others and expects our users to do the same. We have a zero-tolerance policy for intellectual property infringement. This policy outlines our procedures for addressing claims of copyright infringement (DMCA) and other intellectual property violations (such as trademarks).

1. Copyright Infringement (DMCA) Notice

In accordance with the Digital Millennium Copyright Act (DMCA), we will respond expeditiously to claims of copyright infringement committed using the Kaiserawa website that are reported to our Designated Copyright Agent.

To file a notice of alleged infringement, you must provide a written communication (via mail or email) that includes the following:

  • Identification of the copyrighted work that you claim has been infringed.

  • Identification of the material that you claim is infringing, including the specific URL(s) where the material is located.

  • Your contact information: Full name, mailing address, telephone number, and email address.

  • A statement of good faith: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  • A statement of accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  • Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

2. Intellectual Property & Trademark Claims

If you believe that a product or service on Kaiserawa infringes on your intellectual property rights other than copyright (such as trademark, patent, or design rights), please provide the following:

  • The registration number of the trademark/property.

  • The country of registration.

  • A description of the goods/services for which it is registered.

  • Evidence showing the infringing material on our website (URL links).

3. Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our Designated Agent. This must include:

  • Identification of the material that was removed and its original location.

  • A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.

  • Your name, address, telephone number, and email address.

  • A statement of consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the judicial district in which the service provider may be found if you are outside the U.S.).

  • Your physical or electronic signature.

4. Repeat Infringer Policy

Kaiserawa reserves the right to terminate, in appropriate circumstances, the accounts of users who are repeat infringers or who are repeatedly charged with infringement of copyrights or other intellectual property rights.
